The class action states that 2011-2022 Kia Models and 2015-2022 Hyundai models are being called into question for this potential ease-of-theft defect.

Drivers in the lawsuit claim certain Kia and Hyundai vehicles are not fitted with immobilizers –– a critical mechanism in preventing vehicle theft. As a frame of reference, the vast majority of today's cars are equipped with immobilizers.

Immobilizers are security devices that require the smart key associated with the car to start the engine. The car's smart key transmits a specific code to the vehicle which sends a signal to let it know that it's okay to turn on the engine.

If the smart key isn't used or if someone is trying to hotwire the vehicle, the immobilizer prevents the engine from starting.

Due to the lack of this technology in certain vehicles, Kia and Hyundai drivers claim that thieves can use simple devices like USB cables to bypass and start the engine.

If you are a 2011-2022 Kia or a 2015-2022 Hyundai, you may be entitled to greater damages and compensation under the Lemon Law, instead of opting into this class action lawsuit.

Hyundai Motor America recently stated that they are aware of and concerned about the increase in thefts in certain makes and models of Kia and Hyundai vehicles.

They noted that even though all of the vehicles they sell meet or surpass federally regulated motor vehicle safety standards, they've seen users on social media coordinating efforts to target and steal their vehicles.

To assist customers with older vehicles, Kia and Hyundai are working with local law enforcement to make steering wheel locks available for owners who have vehicles that may be targeted in these strikes. Keep in mind that immobilizers were not standard implementations on newly produced vehicles until after November 1st of, 2021.

For newer vehicles, Hyundai Motor America has discovered a security kit that can target common methods of entry that these coordinated thieves are using to hack, access, and drive these vehicles.

The automaker plans to make these available by October 1st, 2022.
